1. Introduction
Welcome to URL2Go, a mobile application service provided by u2go.app, ("Company," "we," "us," or "our"). Our application allows users ("you," "your") to save, manage, and access favorite URLs, playlists, watchlists, and app lists. The mobile application is available for download on the Google Play Store and Apple App Store.
These Terms and Conditions ("Terms") govern your use of the URL2Go App and website. They outline the rights, obligations, and restrictions for users of our services ("Services"). By accessing or using the App, you agree to comply with these Terms.
2. Acceptance of Terms
By downloading, installing, or using the URL2Go App or by accessing or using our website, you signify your agreement to these Terms. If you do not agree to these Terms, you must not download, install, or use the App and must refrain from using our website.
We reserve the right to modify, amend, or replace these Terms at any time. Any changes will be posted on our website and within the App. Your continued use of the App after any changes to the Terms constitutes your acceptance of the new Terms. If you do not agree to any changes, you should stop using the App and website.
These Terms are a part of a larger framework of legal agreements, which may include a Privacy Policy, and other agreements relevant to specific features of the App. By accepting these Terms, you also agree to be bound by these additional policies.
These Terms and the URL2Go App comply with guidelines provided by the Google Play Store and Apple App Store, as well as relevant U.S., EU, and international laws.
By accepting these Terms, you affirm that you are at least 13 years old, as required by U.S. law, and are of legal age to form a binding contract in your jurisdiction. If you are under the age of 18, you affirm that you have reviewed these Terms with a parent or guardian, and they agree to these Terms on your behalf.
3. Privacy Policy
3.1 Data Collection and Use
Your privacy is very important to us. While using the URL2Go App, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. We collect and use this information in accordance with our Privacy Policy, which is available on our website and within the App.
3.2 Third-Party Services
The App may employ third-party companies and individuals to facilitate our Services, provide the Services on our behalf, or assist us in analyzing how our Services are used. These third parties may have access to your personal information only to perform these tasks and are obligated not to disclose or use it for any other purpose.
3.3 Cookies
We use cookies and similar tracking technologies to track your activity in the App and hold certain information. By using the App, you consent to our use of cookies in accordance with our Cookie Policy, which forms a part of these Terms.
3.4 Compliance with Laws
Our Privacy Policy complies with the Google Play Store and Apple App Store guidelines, and applicable laws in the United States, European Union, and other jurisdictions.
4. User Eligibility
4.1 Age Restrictions
The URL2Go App is not intended for use by individuals under the age of 13. By using the App, you represent and warrant that you are at least 13 years old. If you are under 18, you must have parental or guardian consent to use the App and have them review these Terms with you.
4.2 Geographical Restrictions
The App is intended for use only in jurisdictions where it may legally be used. You are responsible for compliance with all local laws and regulations when using the App.
4.3 Account Eligibility
You must provide accurate, current, and complete information during the registration process and update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account password.
4.4 Ineligible Users
We reserve the right to terminate or suspend the accounts of users who violate these Terms, who provide inaccurate, fraudulent, outdated, or incomplete information during the account registration process, or for any other reason in our sole discretion.
4.5 Legal Compliance
By using the App, you represent and warrant that you are not located in a country that is subject to U.S. Government sanctions or that has been designated by the U.S. Government as a "terrorist-supporting" country, and you are not listed on any U.S. Government list of prohibited or restricted parties.
5. User Accounts
5.1 Registration
To fully utilize the features of the URL2Go App, you may be required to register for a user account ("Account"). During registration, you may be required to provide certain personal information, such as your email address, and create a password.
5.2 Account Security
You are responsible for maintaining the confidentiality of your Account's password and are fully responsible for all activities that occur under your Account. You agree to immediately notify us of any unauthorized use of your Account or any other breach of security.
5.3 Data Storage
Your saved URLs, playlists, watchlists, and app lists ("User Content") are stored securely in accordance with our Privacy Policy. However, you understand that no method of electronic storage is 100% secure and we cannot guarantee absolute security.
5.4 Data Deletion
You may delete your Account at any time, for any reason, by following the instructions within the App. Deleting your Account will result in the removal of all your User Content from our systems, in accordance with our data retention policy detailed in our Privacy Policy.
5.5 Account Termination
We reserve the right to suspend or terminate your Account and refuse any current or future use of the App for any reason, including but not limited to violation of these Terms or other policies.
6. Use of the App
6.1 Acceptable Use
The URL2Go App is intended to provide a service for saving and managing favorite URLs, playlists, watchlists, and app lists. Any use of the App that violates this intent or these Terms is strictly prohibited.
6.2 Prohibited Activities
You may not use the App for unlawful purposes, including but not limited to storing or sharing URLs that contain illegal material, or using the App to harass, harm, or defame others. Failure to adhere to this clause will result in immediate Account termination and may result in legal action.
6.3 Service Modifications
We reserve the right, at any time, to modify, suspend, or discontinue the App or any part thereof, with or without notice. You agree that we will not be liable to you or any third party for any such modification, suspension, or discontinuance.
6.4 Updates and Maintenance
From time to time, the App may require updates or maintenance. While we will do our best to offer a smooth user experience, you agree that temporary interruptions may occur and are acceptable under these Terms.
6.5 Third-Party Links
The App may contain links to third-party websites or services. We do not control and are not responsible for the content, privacy policies, or practices of any third-party websites or services. By using the App, you relieve us from any liability arising from your use of such third-party websites or services.
7. Content Ownership
7.1 User Content
Any URLs, playlists, watchlists, and app lists you save remain your property. However, by using the URL2Go App, you grant us a non-exclusive, worldwide, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such User Content in connection with providing the Service.
7.2 Company Content
All intellectual property rights in and to the URL2Go App, including but not limited to logos, designs, text, graphics, pictures, information, applications, software, sound and other files, and their selection and arrangement (collectively, "Company Content"), are the proprietary property of the Company or its licensors.
7.3 Content Responsibility
You are solely responsible for the User Content that you upload, publish, display, link to, or otherwise make available on the App. You accept all risks associated with such User Content, including anyone's reliance on its quality, accuracy, or reliability.
7.4 Content Removal
We reserve the right, at our sole discretion, to remove any User Content that violates these Terms or that may be offensive, illegal, or that may violate the rights, harm, or threaten the safety of any person.
8. Licensing and Intellectual Property
8.1 User Content License
By submitting User Content to the URL2Go App, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the App and the Company's (and its successors' and affiliates') business.
8.2 Company Content License
Unless otherwise stated, we or our licensors own the intellectual property rights for all material on the App. All intellectual property rights are reserved. You may view and/or print pages from the App for your own personal use subject to restrictions set in these Terms.
8.3 Termination of License
Upon termination of your Account, the license granted herein will automatically terminate, and you should discontinue all use of the App. We also reserve the right to terminate or suspend your license to use the App for any violation of these Terms or our policies.
8.4 Trademarks
The URL2Go name and logo are trademarks of the Company or its affiliates. Other company, product, and service names and logos used and displayed via the App may be trademarks or service marks of their respective owners, who may or may not endorse or be affiliated with or connected to the Company.
9. Third-Party Services
9.1 Integration
The URL2Go App may offer integrations with third-party services or platforms. Use of such third-party services will be governed by their respective terms of service and privacy policies.
9.2 Disclaimer
We are not responsible for any issues, legal or otherwise, arising from your use of third-party services integrated with the URL2Go App. You use all such services at your own risk and discretion.
9.3 Data Sharing
When you integrate a third-party service, you may be granting that service access to your User Content and other data stored in your Account. Ensure you have read and understood the third-party's terms of service and privacy policy before proceeding.
9.4 Termination of Third-Party Services
We reserve the right to terminate or suspend any third-party service's integration with the App for any reason, without notice, including but not limited to violations of these Terms.
10. Payments and In-App Purchases
10.1 Availability
The App may offer in-app purchases and subscriptions (collectively, "Paid Services"). Paid Services provide additional features beyond the basic free features available to all users.
10.2 Payment Method
You agree to provide a valid payment method when purchasing Paid Services. All payments are processed through third-party payment gateways. By providing your payment information, you authorize us and our third-party payment processors to charge the applicable fees to your payment method.
10.3 Refunds
All sales of Paid Services are final and non-refundable, except as required by applicable law or as otherwise stated in the App.
10.4 Subscription Renewals
Unless otherwise indicated, subscriptions will automatically renew at the end of each subscription period. You are responsible for canceling your subscription before the renewal if you do not wish to continue the Paid Service.
10.5 Termination of Paid Services
We reserve the right to suspend or terminate your access to Paid Services for any violation of these Terms or our policies. In such cases, no refund will be issued.
10.6 Price Changes
We reserve the right to change the pricing for Paid Services at any time. We will provide you with notice of any such changes.
11. User Responsibilities
11.1 Compliance
Users are responsible for complying with these Terms, as well as any local, state, national, and international laws and regulations applicable to their use of the URL2Go App.
11.2 Reporting Misuse
Users are encouraged to report any content that they believe violates these Terms or any applicable laws. Failure to report such misuse may result in liability, especially in the case of illegal content.
11.3 Account Security
It is your responsibility to keep your Account secure and confidential, including but not limited to, using strong passwords and ensuring the security of your devices.
11.4 Third-Party Services
Users who choose to integrate third-party services with the URL2Go App are responsible for reading and understanding the terms of service and privacy policies of those third-party services.
12. Warranty and Disclaimer
12.1 "As Is" Basis
The URL2Go App is provided on an "as is" and "as available" basis, without any warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
12.2 No Warranty
We make no warranty that the URL2Go App will meet your requirements, be available on an uninterrupted, timely, secure, or error-free basis, or that defects in the App will be corrected.
12.3 No Liability for Content
We are not responsible for any User Content or third-party websites accessed through the App. Any use or reliance on any content or materials available through the App is at your own risk.
12.4 Limitation of Liability
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (a) your use or inability to use the App; (b) unauthorized access to your Account; or (c) any unauthorized use of the App.
13. Limitation of Liability
13.1 General Limitations
To the extent permitted by applicable law, URL2Go, its parent company, subsidiaries, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.
13.2 Cap on Liability
Under no circumstances shall URL2Go's aggregate liability for all claims relating to the App exceed the amount you paid for the App, if any.
13.3 Exception
This limitation of liability does not apply to liabilities that cannot be excluded or limited by law.
13.4 User Acknowledgment
You acknowledge that the limitations set forth in this section are an essential basis of the bargain and of the allocation of risks between the parties.
14. Indemnification
14.1 General
You agree to indemnify and hold harmless URL2Go, its parent company, subsidiaries, officers, directors, employees, and agents from any claims, losses, damages, liabilities, including attorney’s fees, arising out of your use or misuse of the URL2Go App, violation of these Terms, violation of the rights of any other person or entity, or any breach of the representations, warranties, and covenants made by you in connection with your use of the App.
14.2 Cooperation
You agree to cooperate fully with us in the defense of any claim that is the subject of your obligations under these Terms. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will still be required to indemnify us for the attorney’s fees and expenses in addition to any losses, claims, damages, and liabilities incurred by us.
14.3 Survival
The obligations in this section shall survive the termination or expiration of your Account or these Terms.
15. Termination
15.1 By User
You may terminate your Account and discontinue your use of the URL2Go App at any time, for any reason, by following the procedures described in the App or on the u2go.app website.
15.2 By URL2Go
URL2Go reserves the right to suspend or terminate your Account and your access to the App (a) if you are in breach of these Terms; (b) if we are unable to verify or authenticate any information you provide; or (c) for any other reason at our sole and absolute discretion.
15.3 Effect of Termination
Upon termination, all licenses and other rights granted to you under these Terms will immediately cease. URL2Go is not liable for any losses by such termination.
15.4 Survival
Sections that by their nature should survive the expiration or termination of these Terms shall continue in full force and effect subsequent to and notwithstanding the expiration or termination of this agreement.
16. Governing Law and Jurisdiction
16.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of the United States in which it is based, without regard to its conflict of laws principles.
16.2 Jurisdiction
You agree that any legal action or proceeding arising out of or related to these Terms or your use of the URL2Go App shall be filed only in the state or federal courts located in the State of the United States in which it is based, and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.
16.3 International Users
The App is controlled and operated from facilities within the United States. URL2Go makes no representations that the App is appropriate or available for use in other locations. Those who access or use the App from other jurisdictions do so at their own volition and are responsible for compliance with local law.
17. Dispute Resolution
We are available by email at support@u2go.app to address any concerns you may have regarding your use of the App. Most concerns may be quickly resolved in this manner.
For any claim arising between you and URL2Go that cannot be resolved through informal discussions, both parties agree to resolve any such dispute through final and binding arbitration, rather than in court.
Despite the provisions of the arbitration clause, either party retains the right to bring an individual action in small claims court or seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party’s copyrights, trademarks, trade secrets, patents, or other intellectual property rights.
18. Miscellaneous
18.1 Entire Agreement
These Terms, together with the Privacy Policy and any other agreements expressly incorporated by reference herein, constitute the entire and exclusive understanding and agreement between you and URL2Go regarding your use of and access to the App.
18.2 Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be severed, and the remainder of the Terms will remain in full force and effect, provided that the severed provision does not materially affect the original intent of these Terms.
18.3 No Waiver
Failure to enforce any right or provision in these Terms will not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing.
18.4 Assignment
You may not assign or transfer these Terms or your rights hereunder, in whole or in part, by operation of law or otherwise, without our prior written consent. We may assign these Terms at any time without notice.
18.5 Force Majeure
Neither party shall be liable for any failure to perform its obligations under these Terms if such failure results from any cause beyond the reasonable control of such party, including but not limited to mechanical, electronic, or communications failure.
18.6 Headings
The headings in these Terms are for reference only and do not affect the interpretation of these Terms.
19. Changes to Terms and Conditions
URL2Go reserves the right to amend these Terms at any time and without notice. The revised Terms will be effective immediately upon posting to the App and the u2go.app website.
It is your responsibility to review these Terms periodically. Your continued use of the App following any changes signifies your acceptance of those changes.
